When you utilize the Small Claims Advantage website (referred to as "the Site") or any SCA applications or application plug-ins ("Applications"), you consent to adhere to these Terms of Use and comply with all relevant laws and regulations, including but not limited to United States export and re-export control laws. In these Terms, "you" and "your" refer to each user or visitor of the Site or Applications, while "we", "us", and "our" refer to Small Claims Advantage, and "Services" encompass all services we provide.

It is your responsibility to periodically review these Terms. If at any time you find these Terms unacceptable or if you disagree with these Terms, please refrain from using this Site and any Applications. We reserve the right to modify these Terms at any time without direct notification to you. Should you have queries regarding these Terms, feel free to reach out to our Customer Care Center.

By using the Site, Applications, and Services, you confirm that you are at least 18 years of age and legally competent to enter into a contract.

These Terms include an arbitration clause to resolve disputes, waiving rights to jury trials or class actions, and limiting available remedies in case of a dispute, as detailed in Paragraph 6.

Also, review the Small Claims Advantage Privacy Policy and other relevant documents, which are incorporated into these Terms by reference.

SCA provides an online legal platform for users to gain a basic understanding of the law and offers automated software solutions for those who choose to prepare their own legal documents. The Site includes general information on commonly encountered legal issues. SCA's Services include a review of your document answers for completeness, spelling, and internal consistency. We do not, however, review your answers for legal sufficiency, draw legal conclusions, provide legal advice or opinions, or apply the law to your specific situation. SCA is not a law firm and does not perform services that an attorney would provide. Our Services and forms are not substitutes for attorney advice or services.



While SCA endeavors to keep its legal documents current and accurate, we cannot guarantee that all information on the Site or Applications is up-to-date or fully accurate. Legal requirements vary across jurisdictions and may be subject to different interpretations. Legal matters are personal, and no generalized tool like SCA's can fit every circumstance. From time to time, SCA may offer attorney access services and introduce users to attorneys via various methods. However, these services do not create an attorney-client relationship with SCA.

When creating an account to access certain parts of the Site, Applications, or Services, you must provide accurate information as requested. You are responsible for maintaining the confidentiality of your password and account, and you agree not to use others' accounts. Notify SCA immediately of any unauthorized account use. SCA is not liable for losses incurred due to someone else using your account, and you may be held liable for losses incurred by SCA due to unauthorized account use.

In using certain SCA products or services, you may provide personal information. This information is protected under our Privacy Policy. By using the service, you grant SCA a license to use this information for enabling your use of the service, which can be revoked by removing your personal information from the service.



  1. Ownership: The Site and Applications are owned by Small Claims Advantage. All materials provided, including but not limited to information, documents, logos, graphics, and images, are either owned by SCA or by third-party providers. These materials cannot be copied, reproduced, or distributed without permission from SCA, except as permitted by these Terms. Contact SCA for inquiries about obtaining licenses. SCA retains all rights not explicitly granted in these Terms.



  1. Limited Permission to Download: SCA grants you permission to download, view, copy, and print materials from the Site and Applications for personal, non-commercial use, subject to conditions outlined in these Terms. This permission is revocable upon any breach of these Terms, and you must destroy any downloaded materials upon such termination.



  1. Links to Third-Party Sites: The Site and Applications may contain links to other websites. SCA is not responsible for the content or services of these third-party sites and does not endorse them. The inclusion of any link does not imply endorsement by SCA. You bear all risks associated with third-party sites and content.



  1. Use of SCA Legal Forms: SCA offers "fill in the blank" forms for self-help. Your purchase, download, or use of these forms is not legal advice and is not practice of law. These forms are not customized to your particular needs.



License to Use: SCA grants you a limited license to use our forms for personal or internal business use. You cannot modify, exploit, or redistribute the forms except for personal use modifications.

Resale Prohibited: Forms purchased or downloaded may only be used by you and cannot be sold or redistributed without SCA's consent.

  1. DISPUTE RESOLUTION; BINDING ARBITRATION: This section requires you and SCA to arbitrate disputes, waiving jury trials and class actions. You agree to resolve disputes through individual arbitration or small claims court. No class actions or limited/unlimited civil lawsuits are allowed. Arbitration will be governed by the Federal Arbitration Act.



Arbitration Procedures: Disputes with SCA will first go through an informal resolution process. If unresolved, they may be submitted to binding arbitration administered by the American Arbitration Association or, under certain conditions, in court. Consumer disputes use AAA Consumer Arbitration Rules, while non-consumer disputes use AAA Commercial Arbitration Rules.

Opt-Out of Arbitration: You may opt-out of arbitration within 30 days by sending a written Notice of Opt Out to SCA.

Enforcement of Arbitration Award: State or federal courts in California have exclusive jurisdiction over arbitration enforcement.

  1. Additional Terms: Some SCA Services may have additional terms of service.



  1. User Content: You are responsible for content you post on the Site or Applications. SCA is not the publisher of user content and assumes no liability. You grant SCA rights to use your content.



  1. NO WARRANTY: SCA provides the Site, Applications, and Materials on an "as is" basis without any warranties. SCA does not guarantee the accuracy, reliability, or timeliness of the Materials.



  1. LIMITATION OF LIABILITY AND INDEMNIFICATION: You will hold SCA harmless for any indirect or consequential damage arising from your use of the Site, Applications, or Materials, except as prohibited by law.



  1. Unsolicited Submissions: SCA does not accept unsolicited confidential or proprietary information. Any material submitted to SCA becomes its property.
